Terms of Use

Purpose

These Terms of Use govern access to and use of the Actos App service, a construction site tracking application published by Actos App, a company under Swiss law, located at Av. Vibert 36, 1212 Lancy, Geneva, Switzerland.

Access to the Service

The Actos App service is accessible via mobile apps (iOS, Android), the web app and desktop apps (Windows, Mac, Linux). Access requires creating a user account and subscribing to a paid plan after the 14-day free trial period.

User Account

Users agree to provide accurate information when creating their account and to maintain the confidentiality of their login credentials. All activity on the account is the user's responsibility. In case of suspected unauthorized use, the user must notify Actos App immediately.

Subscription and Payment

Subscriptions are billed monthly or annually based on the chosen plan (Solo, Team, Enterprise). Payment is secured via Stripe. Prices are shown in euros including tax. Subscriptions are automatically renewed at each billing cycle unless cancelled beforehand.

Cancellation

Users can cancel their subscription at any time from their account settings, with no fees or penalties. Cancellation takes effect at the end of the current billing period. After cancellation, data remains accessible for 30 days, then is deleted. Users can export their data (PDF reports) before deletion.

Intellectual Property

The Actos App service, its interface, features, source code and documentation are the exclusive property of Actos App. Users are granted a personal, non-exclusive and non-transferable right to use the service within their subscription. Content created by users (reports, photos, observations) remains their property.

User Data

Data created by users in Actos App (reports, photos, observations) belongs to them. Users can export and delete their data at any time. However, contact details of partners, craftsmen and contractors entered in the application may be used by Actos App to enrich the platform's shared directory, accessible to other users. By using the service, the user consents to this pooling of professional contacts. Personal data processing is detailed in our Privacy Policy.

Limitation of Liability

Actos App strives to ensure the availability and proper functioning of the service. However, Actos App cannot guarantee uninterrupted operation and shall not be held liable for indirect damages resulting from the use or inability to use the service. Actos App's liability is limited to the subscription amount paid by the user over the last 12 months.

Applicable Law and Jurisdiction

These Terms of Use are governed by Swiss law. Any dispute relating to their interpretation or execution shall be submitted to the exclusive jurisdiction of the courts of the Canton of Geneva, Switzerland.

Changes to Terms

Actos App reserves the right to modify these Terms at any time. Users will be informed of any significant changes by email or in-app notification at least 30 days before they take effect. Continued use of the service after changes constitutes acceptance of the new Terms.
